Kevin Carey, a former Chicago police officer, is now fighting in court to have his breath test results thrown out of court. Arrested back in May, Carey initially refused to take a breath test, but later agreed to it during the police investigation of his case.
He was arrested for DUI after he waved his gun at a passing motorist in an act of road rage while he was off- duty. The motorist flagged down a nearby on-duty cop and Carey was arrested after they confirmed that the events were true.
The arresting officer detected alcohol on Carey’s breath and noticed his bloodshot eyes and slurred speech. Although he did not agree to a breath test at the time of arrest, he later completed one as part of the police investigation. He argues that he was never made aware that the breath test that he took could be used against him in a court of law.
