Recently, a lawyer denied a motion to overturn a man’s ninth DUI charge, instead choosing to sentence him to up to five years in prison. Robert Kent Vandyke was arrested for driving under the influence in September. He had recently completed his sentence for killing a woman while driving drunk. For that crime of vehicular manslaughter, he had also served six years in prison.
At the September arrest, Vandyke refused to take any form of sobriety tests. However, police reports and witness statements said the suspect had slurred speech, was unsteady on his feet, smelled of alcohol, and was swerving in his lane. The judge decided on the harsh penalty as a result of his previous conviction history.
